I/ We hereby agree on this ________ day of _______________, 2005 to breed

to Stallion  "King N Doc Dun Tuffy" ,   Reg # 2989875

Subject to the following conditions:
1. Mare Owner agrees to pay a stallion service fee of $______________.
Booking fee of $  __________ (non refundable) payable with this contract , and balance, plus all unpaid expenses when mare is picked up.
2. Stallion owner agrees to diligently attempt to settle mare. Mare Owner agrees to give Stallion Owner ample opportunity to settle the mare. If, however, the mare does not settle, Mare owner will hold Stallion Owner harmless. Breeding season is from Feb 1st thru July 31st and both parties agree that any mare bred during this period will be considered as having been bred under terms and conditions of this stallion service contract.
3. It is further agreed that should the mare die or become unfit to breed that Mare Owner may substitute another mare for this or the following breeding season.
4. It is understood that care will be taken with my mare and/or colt to prevent accident, sickness, or death, and I will not hold the Stallion owner responsible for the same.
5. In order to protect the health program on the premises of the ranch, it is required that all mares be current on shots, worming, and have a culture with negative results  prior to their arrival.
6. In case of emergency, permission is granted to the stallion owner/agent to call a veterinarian. All veterinarian expenses incurred by mare and/or foal are the responsibility of Mare Owner.
7. A Live Foal Guarantee is offered by the Stallion Owner. A "live foal" is defined as a foal that stands and nurses without assistance after foaling. Stallion Owner must be notified within 10 days, in writing, that the foal did not stand and nurse. Mare Owner will then be granted return privileges for the next breeding season. If mare fails to foal after second season, Mare owner has the option of breeding a replacement mare the third season, or forfeiting the breeding.
8. The Mare Owner agrees to pay $_________ per day for mare care. The Stallion Owner will have a necessary lien for all fees, charges and expenses in full. Mare Owner shall be responsible for any attorney fees/court costs to collect the same, if necessary.
9. It is the responsibility of Mare Owner to have the Mare preg checked within 60 days of the last breeding date and must notify Stallion Owner if mare is open. It is also the responsibility of the Mare Owner to administer an equine Rhinopneumonitis vaccine at the 5th, 7th, and 9th month of the mare's gestation period.
